How Paternity Is Established in New Jersey
New Jersey law automatically presumes a child born during a marriage is the legal child of both spouses. For unmarried parents, legal parentage must be established through one of two routes before a court can address custody, parenting time, or support.
Certificate of Parentage
A Certificate of Parentage is a voluntary form both parents can sign at the hospital at birth or later through a local registrar or county welfare agency. It’s free and, once signed, establishes legal paternity without a court proceeding.
Family Court Paternity Action
When parents disagree, either parent can file a paternity action in the Superior Court, Family Part. In Monmouth County, these cases are handled by the Family Division in Freehold, alongside related custody and support matters. A judge can order genetic testing, and a match of 95 percent or higher is generally treated as establishing biological fatherhood. A paternity action can generally be filed any time before the child turns 23.
Custody, Parenting Time & Child Support After Paternity Is Confirmed
Establishing paternity gives a father legal standing to seek custody or parenting time. It doesn’t automatically resolve those questions. The court still decides custody and parenting time based on the child’s best interests, the same standard applied in divorce cases.
Child support between unmarried parents follows New Jersey’s income shares model under Court Rule 5:6A, which combines both parents’ incomes to calculate an obligation. Cases between unmarried parents who aren’t divorcing are typically filed as non-dissolution (FD) matters, separate from the divorce docket. Before a judge rules, consent conferences give parents an opportunity to reach agreement on custody or support terms.
